Unicook

Terms and Conditions

About these terms

These terms apply to everything you buy from the Unicook shop at unicook.eu. Unicook is a trading name of Sensia SARL, a company registered in France (RCS Le Mans 891 736 621, EU VAT number FR24891736621), whose registered office is at 191 Avenue Olivier Heuzé, 72000 Le Mans, France. In these terms, “we”, “us” and “our” mean Sensia SARL, and “you” means the person placing the order.

You can reach us by email at orders@unicook.eu, by phone on +33 (0)2 22 44 44 97, or through our contact page. Our full company details are in our legal notice.

Where these terms say “consumer”, they mean someone buying for purposes outside their trade, business or profession. Some of the rights below are given by law to consumers only, and we say so where that applies.

You must be at least 18 years old to place an order.

Placing an order

To order, choose your model and whether to buy outright or subscribe, then enter your details and delivery address at checkout. Before you pay, the checkout shows you the total price, including any delivery charge, and the main terms of what you are agreeing to. Until you pay, you can correct your details or go back and change your order.

Your contract with us is formed when your payment is accepted and we email you to confirm your order. That email sets out what you have bought and its key terms. We keep a record of your order, and you can ask us for a copy at any time.

You can order in English, German, Dutch or French, depending on the version of our site you use.

We may decline an order before we confirm it – for example if the product is out of stock, if the delivery address is outside the countries we deliver to, or if the order appears to be placed for resale. If, after confirming an order, we find we cannot supply it, we will tell you straight away. In either case, any payment you have made is refunded in full.

Prices and payment

Prices are in euros. For delivery within the EU, they include VAT at the rate of the country we deliver to, and the checkout and your receipt show how much of the total is VAT.

The following destinations are outside the EU VAT area: Albania, Andorra, Bosnia and Herzegovina, Iceland, Liechtenstein, Moldova, San Marino, Serbia, Switzerland and Ukraine. A one-off purchase delivered there is an export, so no EU VAT is charged, but import VAT, customs duty or handling fees may be payable when the parcel arrives. A subscription delivered there is treated differently, because your Airis is leased to you rather than sold – see “Subscriptions” below. Any charges at the border are set by the destination country, are not collected by us, and are your responsibility.

We take payment by debit or credit card. Payments are processed securely by our payment provider, Stripe, and we never see or store your full card number.

The price you pay is the one shown at checkout when you place your order. We may change our prices from time to time, but a change never affects an order we have already confirmed. How subscription prices can change is explained under “Subscriptions” below.

Delivery is free of charge on all subscriptions. On one-off purchases a delivery charge applies, which depends on the destination country. It is calculated and shown at checkout, before you pay, and is included in the total you confirm.

We normally despatch orders within 7 working days. If we expect your order to take longer, we will contact you within one working day of the order being placed to tell you the expected delivery date, and you can choose to cancel it for a full refund.

All goods are sent by a tracked service with a reputable carrier, and a signature is required on delivery. Once your order has been despatched, we email you its tracking number at the address you gave us.

If your parcel is lost or damaged on its way to you, please let us know and we will send you a replacement as soon as possible, at no cost to you.

Responsibility for the goods passes to you when you, or someone you have nominated, take delivery of them.

Subscriptions

A subscription supplies your Airis Sense Wi-Fi as an ongoing service rather than as a one-off sale. It works as follows.

  • Minimum term. Your subscription starts with a 6-month minimum term, which you pay for in full when you subscribe. Once the withdrawal period described below has passed, the minimum term cannot be ended early and those prepaid months are not refundable.
  • Deposit. You also pay a refundable deposit when you subscribe. When your subscription ends, you send your Airis back to us – we email you instructions and pay the return postage – and we refund your deposit once we have received it.
  • Monthly payments. After the minimum term, your subscription is billed monthly to the card you subscribed with. The monthly price is reduced for the second and subsequent years of the subscription. The amounts are shown at checkout and in the email confirming your subscription.
  • No fixed end date. After the minimum term, your subscription continues from month to month, with no further minimum term, until you cancel it.
  • Reminders. We email you 30 days before your first monthly payment and 30 days before the monthly price changes. After that, we email you a summary of what you are paying every 6 months.
  • Cancelling. You can cancel at any time, yourself, at unicook.eu/shop/subscription/, or by phoning or emailing us. Your subscription then stops at the end of the period you have already paid for, and nothing further is taken.
  • Delivery. Delivery is free of charge on every subscription.
  • Ownership. Your Airis is leased equipment: we lend it to you for as long as your subscription runs, and we do not sell it to you. It remains the property of Sensia SARL, the French company that sends it to you, and it must be returned to us in France when your subscription ends.
  • Accessories and packaging. It is important that you retain the original packaging, instruction manuals, and any accessories that are supplied with your Airis for the lifetime of the subscription, as they will need to be returned to us when your subscription ends. If any of them are missing when you return your Airis, we will deduct the cost of replacing them from your deposit.

Subscriptions outside the EU. Because your Airis stays ours and comes back, we send it outside the EU as a temporary export of leased equipment, not as a sale. In Switzerland and Liechtenstein it is declared for temporary admission, so it should not be taxed as a permanent import of the device. You are the importer: any import VAT that is due, and the carrier’s customs-clearance fee, are payable by you when it arrives. When your subscription ends, please return your Airis using the return instructions we send you, which include the customs declaration that closes the temporary admission. A unit sent back any other way may be treated as a new import, and may be charged as one.

If we end your subscription. We may end your subscription if a payment is still unpaid 14 days after we have told you about it, or if you seriously break these terms. If we do, we may collect your Airis at your expense. We will deduct unpaid subscription payments and any collection costs from your deposit and refund the rest. If you owe more than the deposit, we invoice you for the difference.

If we ever need to change the price of your subscription, or these terms as they apply to it, we will email you at least 30 days before the change takes effect. If you do not wish to continue on the new terms, you can cancel before then and you will not be charged under them.

Your right to change your mind

As a consumer, the law gives you the right to withdraw from your purchase – without giving any reason – within 14 days of the day you, or someone you have nominated, receive the goods. We extend this to 30 days from delivery, on both one-off purchases and subscriptions, and everything in this section applies throughout those 30 days.

How to withdraw. Tell us clearly that you have decided to withdraw – by emailing orders@unicook.eu, by phone, or by post to the address at the top of these terms. You can use the model withdrawal form at the end of these terms, but you do not have to. On a subscription, you can also do it yourself at unicook.eu/shop/subscription/, using “Cancel and request a full refund”. To meet the deadline, it is enough to send us your decision before the 30 days are up.

One-off purchases. Once we have your decision, we will email you instructions for returning the goods. Returns must be made within 14 days of notifying us, and any products must be returned in their original packaging with all accessories and instructions. If any of these are missing, we may deduct the cost of replacing them from your refund. We pay the return postage. We refund everything you paid, including the standard delivery charge, within 14 days of receiving your decision, although we may wait until we have the goods back or you have shown us that you have sent them, whichever is sooner. You are only responsible for any loss in the value of the goods that results from handling them beyond what is needed to establish their nature, characteristics and functioning.

Subscriptions. If you withdraw from a subscription, we will email you instructions for sending your Airis back, and we will pay for the return postage. Please send it back within 14 days of telling us. We refund everything you have paid, including the minimum-term payment and the deposit, within 14 days of receiving your decision, although we may wait until we have your Airis back or you have shown us that you have sent it, whichever is sooner.

We refund to the card you paid with, unless you agree otherwise, and you will not be charged any fee for the refund.

Warranty and legal guarantee

Your legal guarantee. Whatever you buy from us, and whichever way you pay for it, you have a legal guarantee of conformity for 2 years from delivery, under Directive (EU) 2019/771 as implemented in your country. If the goods are faulty or not as described, we must put it right by repairing or replacing them, or, if that is not possible, by reducing the price or refunding you. This is a right the law gives you, and nothing in our warranty below limits it.

Our warranty. On top of your legal guarantee, your Airis comes with a commercial warranty:

  • on a one-off purchase, the 2-year manufacturer's warranty given by Safera Oy, the manufacturer of our products, and a third year from us upon registration of your product. You can register through your online Welcome Pack, which we email you when your order is despatched;
  • on a subscription, an unlimited warranty for as long as your subscription runs.

The warranty depends on installation by a qualified electrician, and you may be asked for proof of installation – such as an invoice from an electrician – when you make a claim under it. This condition applies to the warranty only, not to your legal guarantee.

Whichever applies, make your claim through us: email orders@unicook.eu with your order reference and a description of the fault.

Our responsibility to you

If we fail to keep to these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our failure, but not for loss that could not have been foreseen when the contract was made.

Our products add a layer of protection by helping to prevent cooking fires before they start. They do not replace smoke alarms, which remain essential, and they must be installed and used in line with their installation and user manuals.

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, for defective products under product liability law, or in any other case where the law does not allow it. Nor do these terms affect your statutory rights as a consumer.

Errors on our website

We take care to keep the information on this site accurate and up to date, but mistakes can happen. If we find an error in the price or description of something you have ordered, we will contact you before your order is despatched, and you can choose to go ahead on the corrected terms or cancel for a full refund.

We are not responsible for the content of other websites we link to.

Your personal data

How we collect and use your personal data, including when you place an order, is set out in our privacy policy.

Complaints and disputes

If you are unhappy with anything, please contact us first at orders@unicook.eu or on +33 (0)2 22 44 44 97, and we will do our best to put it right.

If we cannot resolve your complaint, you can refer the dispute, free of charge, to the consumer mediator we are registered with: CM2C (Centre de la Médiation de la Consommation de Conciliateurs de Justice), 49 rue de Ponthieu, 75008 Paris, France – online at www.cm2c.net, or by telephone on +33 (0)1 89 47 00 14. You must first have made a written complaint to us, and you must refer the dispute to the mediator within one year of that complaint.

These terms are governed by French law. If you are a consumer, this does not take away any protection you have under the mandatory law of the country where you live, and you may also be able to bring proceedings in the courts of that country.

Changes to these terms

We may update these terms from time to time, for example to reflect a change in the law or in how we work. The terms that apply to an order are the ones in force when you placed it. Changes that affect a subscription you already have are made as described under “Subscriptions” above.
